General Terms and Conditions
of Sale of Products and Service at rubberstamp24.co.uk
§1 General Information
The within Terms and Conditions (hereinafter referred to as T&C) regulate distant selling agreement regarding placing and completion of orders, complaints and returns of purchased product. The T&C are in force as of 01st May 2016.
The owner and operator of rubberstamp24.co.uk is Mr Piotr Szulc trading as P&P Invest with registered office at ul. Tadeusz Bloka 4, 10-751 Olsztyn, Poland, VAT No. / Tax ID: PL739359707, REGON 280404401, hereinafter referred to as “the Operator” or “the Owner”.
All products sold at rubberstamp24.co.uk are new, free from legal rights of third parties, free from material damage and have been put legally into circulation unless it is explicitly stated that the product is second-hand / previously used.
The subject matter of the within Terms and Conditions is the sale of products offered at rubberstamp24.co.uk pursuant to an electronic agreement between the parties, i.e. the Operator and the Buyer (hereinafter referred to as “the Client”).
§2 Placing orders and their completion
The orders can be placed 24 hours a day, 7 days a week throughout the year via our website rubberstamp24.co.uk.
Placing an order via the website shall be construed as adding a product (i.e. designed image / print to appear on the stamp and / or the stamp itself from the selection available on rubberstamp24.co.uk) and completion of the order form as per the instruction there.
The Operator of rubberstamp24.co.uk is not responsible for the errors in the design of orders placed by the Buyer.
All orders shall be made using the interface available on rubberstamp24.co.uk.
The interface allows two types or designs:
upload of electronic files designed by the Buyer. The formats allowed are: pdf, jpg, jpeg, tiff, bmp and the maximum size of the file, which can be uploaded is ……… mb.
The interface also allows the Buyer to design their own stamp by selecting the font, content / text of the stamp, colour of the ink, type of stamp.
The Buyer is responsible for the correct preparation of the design of the stamp whether in the self-service facility or the uploaded file. The Operator of rubberstamp24.co.uk does not, as a rule, interfere in the designs provided. On rare occasions we reserve the right to optimise the design to the stamp chosen, spacing between the lines, or size of the font to ensure legibility.
The Operator of rubberstamp24.co.uk does not interfere in the wording of the design even if there appear to be obvious spelling mistakes or typographical errors. The Buyer shall be ultimately and solely responsible for the wording of the design and the Operator shall not accept any liability in this regard.
After the order is placed online the Buyer shall receive an email confirmation of the order. The email will contain information regarding the products ordered, value of the order, form of payment and shipping / delivery information. Paper confirmation of the order will be sent with the ordered item(s). The Buyer may receive the confirmation by email of they so consent.
The payment for the products ordered may be made via PayPal using:
quick online payment (PayPal).
The order will proceed to completion only on receipt of payment:
in case of PayPal payment – as soon as the Operator of rubberstamp24.co.uk receives confirmation of payment.
Every order will be accompanied by an VAT invoice in an electronic format sent to the Buyer’s email address.
If the payment is not made within 14 days from the date of the order, the Operator of rubberstamp24.co.uk reserves the right to consider the order cancelled and withdrawn by the Buyer.
All products offered for sale on the rubberstamp24.co.uk are available for sale. Should the item become unavailable due to simultaneous purchases made by various Buyers, the orders will be completed on the first come first served basis (including time of payment), and those where the Operator became out of stock will be completed as soon as the stock is replenished. Should a product or colour be unavailable, the Buyer will be offered a substitute and, if accepted, completed. Should an item be unavailable from the manufacturer a refund will be made.
The Buyer will be informed at every stage of the total price, inclusive of the cost of shipping and insurance for the duration of shipping.
The order may be cancelled by sending an email to rubberstamp24@gmail.com prior to the sending of the order to completion.
The Buyer will be informed of the shipping out of the order by email.
Should the Buyer rescind / withdraw from the transaction for any reason allowed under these Terms and Conditions, they shall bear the costs of return of the product.
§3 Conditions of completion of order
Design which is either incorrect or illegal will not be completed.
We do not complete stamps which contain national symbols.
Confirmation of order is generated automatically by rubberstamp24.co.uk and sent ot Buyer’s email address
The stamps are completed in the style and model chosen by the Buyer.
§4 Delivery and collection
Products ordered are delivered using postal or courier service, at the option of the Operator.
The costs of the shipment will be notified to the Buyer in the summary of the “Basket” on the rubberstamp24.co.uk website.
The products order shall be dispatched within 2 working days after the receipt of the payment and subject to the availability of the product.
If the packaging of the parcel upon delivery is damaged, the Buyer may refuse to accept the parcel and proceed to making a complaint in line with the procedures, terms and conditions of the delivery service provider.
Should the parcel be accepted, it is deemed that the Buyer has no issues with transport / shipping / delivery. Any complaints thereafter shall be in respect of the differences between the design supplied and the stamp received and shall be made within 7 days from the time of collection / receipt of the order.
The Buyer is entitled to a full refund of the price paid if the order is not completed by rubberstamp24.co.uk within days from the receipt of the payment. Should an error in payment be made and an amount in excess of the amount due be paid, the balance undue to the Operator of rubberstamp24.co.uk shall be returned to the Buyer by the same means as the payment was made.
If the shipment is not received at the address specified within 21 (twenty one) working days the Buyer shall notify the Operator of the fact so that the issue may be resolve and the Operator will make any reasonable endeavours to do so.
§5 Rescission or cancellation of the order
Every Buyer can cancel the order before making a payment by sending an email to the Operator of rubberstamp24.co.uk.
Following payment only consumers, as defined, can cancel the order and only in relation to the goods that have not been tailor made.
The Consumer Buyer’s right to cancel an order for goods starts the moment you place your order and ends 14 days from the day you receive your goods.
If your order consists of multiple goods, the 14 days runs from when you get the last of the batch.
This 14 day period is the time you have to decide whether to cancel, you then have a further 14 days to actually send the goods back. The Consumer Buyer must notify the Operator of their choice to cancel by sending scanned cancelation form to rubberstamp24@gmail.com.
The cancelation form will be added to the posted order. It can also be found at the end of these Terms and Conditions.
You should get a refund within 14 days of either the trader getting the goods back, or you providing evidence of having returned the goods (for example, a proof of postage receipt from the post office), whichever is the sooner. The Operator does not refund or cover the cost or returning the order.
A deduction can be made if the value of the goods has been reduced as a result of you handling the goods more than was necessary.
The Operator will refund also the basic delivery cost of getting the goods to you.
§7 Complaints
The Operator of rubbesrtamp24.co.uk deals with any complaints regarding quality of the product in accordance with the Polish Civil Code and the Consumer Protection Act, which understood to be complaint with the law of the European Union in relation to consumer protection.
If the goods sold are faulty, we can give a discount (if acceptable), a full refund or replace the item in a reasonable period of time.
To make a complaint the Buyer shall complete the “Contact” form on the website with “COMPLAINT” clearly indicated in the subject line. Before returning the item, the Buyer shall contact the Operator with description of the fault and photographs of the fault.
If the complaint is justified, the Operator will provide instructions as to the return of the item. In certain circumstances the goods may not need to be returned and a replacement item will be posted to the Buyer. If the item needs to be returned, the Operator will request the goods to be returned and only then will cover the cost of returning the goods.
§8 Intellectual property
All material intellectual property right to photographs, texts and other creations on the rubbesrtamp24.co.uk (including the design of the website itself) belong to the Operator of the site. None of the rights are transferred to the Buyer during any transaction on the rubbesrtamp24.co.uk website.
Any use of the materials (photos, graphics, texts and other creations – including the design of the website itself) without express written permission of the Operators is prohibited and is considered to be a breach of the intellectual property rights even if there are no profits made.
The Buyer warrants and guarantees that they have the right to the design sent to the Operator of rubbesrtamp24.co.uk to be placed on a stamp and indemnifies the Operator from any action in relation to same.
§9 Data Protection
The personal data of the Buyer shall be used only to complete the agreement and deliver the order.
With the Buyer’s permission the personal data can also be used to offer new products, services and special offers in rubbesrtamp24.co.uk.
After registration every Buyer has the right to access their data and amend same via the “User Profile” tab on our website. The data provided is kept and secured in accordance with the laws of the European Union in relation to Data Protection and the Polish law, which is understood to be fully compliant with the EU Regulations and Directives regarding Data Protection.
